Amazon India Found Guilty Of Selling Products With A Copied Logo; Fined ₹340 Crore

The Delhi High Court ordered an Amazon unit to pay $39 million (₹340 crore) in damages for unlawfully using the Beverly Hills Polo Club (BHPC) logo on products sold through its Indian website.

The ruling follows a 2020 lawsuit by Lifestyle Equities, BHPC’s parent company, accusing Amazon of selling lower-priced clothing with a similar horse logo. The court order revealed that the infringing brand was owned by Amazon Technologies and sold on Amazon India.

The court found that the logo on these products was "hardly distinguishable" from BHPC’s registered trademark and issued a permanent injunction against Amazon, prohibiting it from sale, advertising, or business dealings of products with a similar logo.

The court highlighted that Amazon was aware of Beverly Hills Polo Club’s exclusive rights, having faced similar trademark cases in other countries, including the UK.

Amazon faced similar allegations from Lifestyle Equities in London in 2019. Last year, Amazon lost an appeal after a ruling found it had infringed U.K. trademarks by targeting British consumers through its U.S. website.
