Uttarakhand has made history by becoming the first state in post-independence India to implement the Uniform Civil Code (UCC). The law applies to all residents except Scheduled Tribes and protected communities.
What is the UCC?
The UCC aims to standardize personal laws related to marriage, divorce, inheritance, and succession across all communities. It ensures equal rights and promotes social uniformity while empowering women.
Key Provisions of the UCC
The UCC mandates the registration of marriages, divorces, and live-in relationships to safeguard property and children’s rights. Legal marriage requirements include minimum age limits and mental capacity.
Proponents argue that the UCC promotes equality and women's empowerment by replacing diverse personal laws with a common set of regulations. Critics warn of potential societal divisions and cultural concerns.
The Uniform Civil Code Journey In Uttarakhand
In March 2022, Uttarakhand's cabinet formed an expert panel led by retired Supreme Court Judge Ranjana Prakash Desai. The draft was submitted in February 2024, followed by presidential assent in March 2024.
After the draft approval, a second committee led by former chief secretary Shatrughna Singh framed rules for implementation. The final report was submitted, and the cabinet approved the UCC for rollout.
