Government’s Apathy

Through your esteemed newspaper, I like to draw the kind attention of the Chief Minister on the subject. This is about a prestigious housing project in Guwahati, named Regent Paradise jointly developed by Assam State Housing Board and a Kolkata-based builder over a plot owned by the Board. It was to be completed in September 2010. The builder has started giving possession of the flats to the buyers since 2013 without completing and without occupation certificate from the GMDA. The builder did not construct many promised facilities, made unauthorized constructions, sold some common areas and also executed sale deeds with a lot of deviations from the Sale Agreements. The housing complex is not yet handed over to the Society. The flat owners through their society have been writing to the builder, State Housing Board and complaining to the GMDA for the last few years. They have met the officials of the Housing Bard and GMDA, but there is no result. Several letters/mails have been sent to the CEO of the GMDA and higher officers of the Guwahati Development Department. Several letters/mails have been written to the Housing Minister and the Chief Minister. Appointments with the CM have been sought several times. Nobody is responding, nor is there any action by the government departments concerned. The Society complained to the PMO that forwarded the same to the State government, but nothing happened. Finally, a detailed complaint was lodged to the Real Estate Regulatory Authority (RERA) as per provisions of the RERA Act, 2016 in February 2018. Alas, RERA, a quasi-judicial body and headed by a high-level government officer has not taken any action on our complaint till date. Left with no option the Society filed a writ petition in the honourable Gauhati HC in May 2018. Here also the Regulator, RERA failed to respond to the notices issued by the HC. Finally, in November 2019 the HC has passed an order with direction to the RERA to consider our complaint and pass appropriate order preferably within two months, i.e. by January 15, 2020. Unfortunately, again we have not seen any action from the RERA till date and now the society may have to file a contempt petition. It is needless to say that some retired senior citizens like a few of us have put their life's savings in the housing project for a comfortable and decent living after retirement.

I appreciate the efforts of our Chief Minister to eradicate corruption in the state and make the functioning of the government efficient. I presume that this matter has not been brought to his personal notice. Therefore, through your esteemed newspaper I like to bring the matter to the notice of the Chief Minister. I hope, the Chief Minister will personally intervene and give justice to the flat buyers of Regent Paradise.
