APSC Cash-For-Job Scam: IO Proves Judicial Officer’s Wife Accepting Rs 1 Crore

GUWAHATI, Sept 21: The police investigating the cash-for-job scam in the Assam Public Service Commission (APSC) have successfully established the fact that Rs 1 crore has been paid to the wife of a judicial officer for ‘favourable bail orders’ to some accused.

According to sources, in his investigation report Dibrugarh ASP Surjit Singh Panesar, who is the investigating officer (IO) in the case, has said that all such revelations have been made by investigating facts within the legally-permissible limits. The investigating officer has nowhere named the judicial officer, nor has he named the wife of the officer in his report that has, however, made it crystal clear that Rs 1 crore has been handed over to the wife of the judicial officer at Udalguri.

One who outsmarted themselves in the entire conspiracy to ‘disrupt’ the investigation into the scam are accused Surajit Choudhury and advocate Sailendra Kumar Sarma Baruah. The report said: “They conspired and took money from the guardians of other arrested accused persons with a view to bribe the judicial officer and thereby taking favourable bail orders of the arrested persons.”

The telephonic conversation between Surajit Choudhury and advocate Baruah has made their plan of bribing the judicial officer and thereby getting ‘favourable bail orders’ crystal clear, the report of the investigating officer claims. The report further claims that ‘the intercepted voice files of arrested accused Choudhury and advocate Sarma Baruah have been taken from the SB Headquarters and sent to the Forensic Science Laboratory along with their voice samples for opinion…their voice samples matched with the legally intercepted voice of the arrested accused persons.”

“In the voice samples it is clear that Surajit Choudhury has handed over Rs 1 crore to advocate Sailendra Kumar Sarma Baruah to be handed over to the judicial officer. And as per their conversation, the money was handed over at Udalguri in the hands of the wife of the particular judicial officer,” the report claims.

The report says that the two arrested accused have tried to disrupt the ongoing investigation process of Dibrugarh police case (936/16) and committed an offence under section 7(A)/8/12/13(2) of the Prevention of Corruption Act read with Section 120(B)/109/420/201/511 of the IPC.

When the accepted norm in the judiciary – the burden of proof lies with the prosecution – is taken into consideration, the proof (evidence) established by the investigating officer in this case has given more teeth to the prosecutor.
