Hisar Court Delivers Fast Track Justice, 17-Year-Old Juvenile Sentenced To 20 Years‘ Jail On Charges of Rape And Murder Of Minor

Gurugram: In what could be called a true face of justice against heinous crime like rape and sexual assault, a Hisar court in Haryana sentenced a 17-year-old to 20 years of imprisonment for raping and killing a six-year-old girl of Uklana town in Haryana's Hisar district last year.

Reportedly the incident happened on December 8, 2017, where the accused abducted and later brutally raped and murdered the six-year-old minor girl.

On Wednesday, the verdict was pronounced by D R Chalia, Additional District and Sessions Judge, Hisar in which the convict was fined with Rs 80,000 and in case of default, he would have to undergo further imprisonment of two years.

It may be mentioned that the convicted teenager was earlier being tried as a juvenile, but the case was later shifted to district and session court.

It may be reiterated that the Juvenile Justice (Care and Protection of Children) Act, 2015, was amended to allow 16 to 18-year-olds to be tried as adults for heinous crimes such as rape and murder.

Meanwhile, in this case, the convict will be lodged at a home for juvenile offenders in Sonipat till he turns 21, and later shifted to a regular jail for serving the rest of his sentence as an adult offender.

Soon following the verdict of the District court, Pradeep Saini, advocate for the accused told media that, "The accused has been awarded 20 years of imprisonment by the court each under section 376 (rape), 302 (murder), the SC/ST Act, the POCSO Act, and seven years' imprisonment each under section 363 (kidnapping), section 450 (house-trespass in order to commission of an offence)."

He further added that all the sentences will run concurrently.

It may be mentioned that last year, on December 9, the brutally disfigured body of the girl was found in a deserted street near the telephone exchange building in Uklana.

According to the doctors who conducted the post-mortem informed the court that brutal sexual assault by the assailant and later treating her in a violent and horrific manner had resulted in her death.

Police sources told media that the minor victim girl was sleeping with her mother inside her hut when she was abducted by her perpetrator. The father of the girl was away in Gurugram that night.

Explaining the court about the brutality of the crime, doctors of Hisar civil hospital who had conducted the postmortem on the victim told the court that in their report that the assailant inserted a wooden stick into the private part of the girl, thus rupturing her intestines.

The sexual assault and the ruthlessly ruptured intestines had caused her death. Scratch marks were also found on the body of the girl.

A case under relevant sections was registered in Uklana Police Station on December 9, 2017.

It may be mentioned that the then SP Hisar, Manisha Choudhary led a special investigation team (SIT) that was constituted in order to investigate the crime.

Reportedly, a spokesman of the State police department, Chandigarh told the media this crime was a first-of-its-kind as it was for the first time that the Haryana Police had got narco-analysis test, polygraph and brain mapping test of the accused done from Forensic Sciences Laboratory, Gandhinagar in Gujarat.
