Seven-year jail for former Darrang ZP president

MANGALDAI, November 21: District Sessions Judge of Darrang, G Barua in a judgment passed on Monday, awarded 7 years rigorous imprisonment with a fine of Rs, 25,000 each to former president of Darrang Zila Parishad and a prominent Congress activist Tofajul Hoque and his brother Chand Miya in connection with Sessions case No. 122(DM) 10 under section 364/302/34 IPC (committed by Chief Judicial Magistrate, Mangaldai in GR case No. 637/08).

The Sessions Judge delivered the judgment on November 18 and during today’s hearing, pronounced the sentence. According to the case, on June 22, 2008 at about 3.30 am, the accused Tofajul Hoque and his brother Chand Miyan along with Abdul Quddus, Jehirul Islam alias Bhaity alias Jafar Ali Ahmed and Hakim Ali had forcefully taken away one Abdul Mazid from his residence at Baghpori near Mangaldai town using the Scorpio vehicle owned by Tofajul Hoque and killed him in the house of Tofajul Hoque and thereafter dumped the body in front of Mangaldai Civil Hospital.

On the basis of the FIR lodged by Rahim Ali, the younger brother of the deceased, Mangaldai Police registered a case (No. 255/08 under section448/364/302/34 IPC) against the accused Tofajul Hoque, Chand Miyan, Kuddus Ali, Hakim Ali, Bhaity Ali and others. In the same incident, another person mely Hamidur Rahman was killed and on the basis of the FIR lodged by one Rahima Khatun, the Mangaldai Police registered another case (No. 256/08 under section 341/342/302/34 IPC) accusing Tofajul Hoque, Chand Miyan, Kuddus Ali, Hakim Ali, Jehirul Islam alias Bhaity Ali and others.

“Taking law into one’s own hand, without allowing the law to take its own course, is a dangerous phenomenon, the tendency of which is increasing. A strong message is to be given to those persons with the tendency of taking law in their own hands. In the instant case, as the accused persons Tofajul Hoque and Chand Miya had taken law in their own hands and brought disaster to at least to one family where one person has died. In my view such persons should be adequately punished so that it also serves as a deterrent to like-minded people,” observed Sessions Judge G Barua on Monday while passing the judgment.

In default of payment of fine, the accused persons were awarded further rigorous imprisonment for six months. However, except for Tofajul Hoque and Chand Miya, all the other accused persons were acquitted from the charge as per the judgment Public Prosecutor Gobinda Ram Barua appeared for the prosecution while advocates Mirza Gias, SS Dey, NS Basak, N Ahmed and SI Ahmed appeared for the accused persons. Tofajul Hoque has been lying in bed for the last couple of years due to ailment and was produced before the court on wheel chair.
