Doctor, nurse of LGB Civil Hospital get two years’ RI for medical negligence

TINSUKIA: The Additional Chief Judicial Magistrate of Tinsukia, Dr Chetana Khanikar, in a case related to death due to medical negligence, has convicted Dr Marami Dutta and a nurse, Bimala Dutta attached with LGB Civil Hospital, Tinsukia to rigorous imprisonment of two years and a fine of Rs 3,000 each i/d simple imprisonment for 15 days. The judgement also stated that under section 428 of CrPC, the period of detention already undergone by the accused during the investigation, inquiry and trial of the case is set off against the sentence of the imprisonment.

Pradip Kakoti was admitted to LGB Civil Hospital on October 16, 2013 with malaria symptoms and was administered saline by nurse Bimala Dutta while the attending physician Dr Marami Dutta advised the attendant to bring one Falcigo injection. After a couple of hours the patient expired. When the relatives came to receive the body, they noticed that the Falcigo injection vial was lying on the table un-administered near the body. During the trial, the prosecution had examined nine witnesses, seven documentary evidence and two material exhibits. The hospital sources said that following death of the patient, Dr Marami Dutta resigned from the post and left for Jorhat.
