All APSC Recruitments to be Under 2019 Procedures: High Court

GUWAHATI: The Fight against Injustice of APSC has said that now on all recruitments in the APSC (Assam Public Service Commission) will be in accordance with the Commission’s 2019 Procedure which suppressed the Commission’s 2010 Rules.

Addressing a press meet in Guwahati on Tuesday, on behalf of the Fight against Injustice of APSC, Manas Pratim Baruah said: “First we moved the High Court challenging the Constitutional validity of the Assam Public Services (Procedure of Conduct of Business) Rules, 2010. However, the APSC informed the High Court in its affidavit that it had repealed its 2010 Rules and implemented the Assam Public Services (Conduct of Business) Procedure 2019 from April 1, 2019. However, the Clause 12.2 of 2019 Procedure says – “… and any proceedings in relation to interviews, selections, or competitive examinations pending on the date of commencement of these procedures may be continued and completed in accordance with the provisions of the Rules in force prior to such commencement”, occurring in Clause 12.2 of the 2010 Rules. The petitioners (Pranjal Kumar Sarma and three others) challenged the above-mentioned portion of Clause 12.2 of the 2019 Procedure.

The High Court bench comprising Acting Chief Justice Manish Choudhury ordered that ‘all pending interviews, selections and competitive examinations, even if occasioned by advertisement(s) issued prior to April 1, 2019, shall be guided by the Procedure 2019,” Baruah said.

Baruah further said that the State government is now going to amend the Assam Public Service (Combined Competitive Examinations) Rules 1989 and to replace it with ‘the Assam Public Services Combined Competitive Examinations (Amendment) Rules, 2019.

Baruah said that this amendment is going to make the APSC’s examination system on a par with the ones being conducted by the UPSC.
