Surrender of land in eco-sensitive zones

GUWAHATI: The TDR (Transferable Development Rights) is now effective in Assam. The process for the issuance of TDR certification has already started under the GMDA (Guwahati Metropolitan Development Authority) for the first time.

According to the TDR, a person owning land in any eco-sensitive zone where he cannot erect any heavy construction can get 'extra construction rights' according to the floor-area ratio (FAR) of his plot at his other plot or plots outside the eco-sensitive zone if he surrenders the plot in the eco-sensitive zone to the GMDA or any other authority as the case may be.

According to the GMDA, since a person owning land in any eco-sensitive zone like wetlands cannot erect any building there, the person has the option to surrender his plot to the GMDA. In return, the GMDA will grant the right to erect buildings elsewhere in accordance with the FAR of the surrendered plot. According to a GMDA source, if a person gets a TDR certificate for erecting a building of 1,000 sq ft, he will have the right to erect a building of almost 2,000 sq ft on another plot that is the same in area as the surrendered plot.

The TDR certificate is saleable. A person with a TDR certificate can sell the certificate if he does not have any extra plots of land to erect a building. The person buying a TDR certificate will get the benefit of erecting a building with an extra area based on the FAR.

According to sources, GMDA has started this system to enable people who own land in eco-sensitive zones where they cannot erect any buildings to erect buildings elsewhere. The GMDA will launch a portal shortly to bring the system online.

According to sources, the TDR is voluntary and not compulsory. The TDR certificate obtained is equal to the reserved rights obtained by the owner on surrendering his property to the authority concerned.
