
Court asks principal in charge to vacate disciplinary notices after compliance

GUWAHATI: The bench of Justice Robin Phukan of the Gauhati High Court set aside a series of notices issued by the principal in charge of Tezpur Law College debarring a student of the college from attending several internal examinations and other classroom activities.
The principal in charge of the college had to take such stern disciplinary action against the student for his alleged unruly behaviour at the fresher social function of the college on August 31, 2024, and not regarding the subsequent directives issued by the college authority.
Though this high court stayed the notices issued by the college authority against the alleged unruly behaviour of the student, the principal in charge of the college filed an interlocutory application (I.A. (Civil) No. 3669/2024, under Article 226(3) of the Constitution of India) for vacation/alteration/modification of the interim order issued by this court on November 5, 2024, in connection with the WP(C) No. 5662/2024 filed by the student earlier.
After hearing both parties and taking the career of the student into consideration, the bench asked the principal in charge to vacate the series of notices against the student on the conditions that (i) the student will have to tender an apology, (ii) publish his apology in two newspapers, one English and one vernacular, and (iii) pay an amount of Rs 10,000 within a month. In the event of the student not complying with this order within two months, the series of notices against the student will reappear on the notice board.
