GUWAHATI: The District and Sessions Court, Kamrup (M) has stayed the order of the Court of Civil Judge 3, Guwahati that declared the recent election of the AGP 'null and void'.

The AGP challenged the order of the Court of Civil Judge 3 in the District and Sessions Court. Hearing the case filed by the AGP, the judge admitted it on Wednesday and stayed the judgement issued by the Court of Civil Judge 3.

On behalf of the AGP Advocate Bijan Mahajan spoke. He was assisted by Advocate Nausad Alam and Advocate Gautamjyoti Saikia. They argued that the Court of Civil Judge 3 issued the order without hearing the views of the AGP. Talking to the media later, Advocate Mahajan said, "With the staying of the Court's order, Atul Bora is the president and Keshab Mahanta is the working president of the AGP.

"Before staying the earlier order, the court heard the opinions of both the parties today. The AGP did receive the order of the Civil Court, but after the conclusion of the general conference. Those who filed the case against the general conference of the AGP were already expelled from the party." The Court of Civil Judge 3 had declared "null and void" the recent elections of the AGP on September 5, 2020 on two counts – the elections had violated the COVID-19 protocols and also the AGP constitution. The elections were held during the AGP's general conference at the party headquarters in Ambari here on August 27. Both Atul Bora and Keshab Mahanta were re-elected for the next three-year term as the party's president and working president respectively.

But before the conference, a few members of the Guwahati unit of the AGP had moved the Court against the slated general conference. The Court, on August 26, directed the AGP not to hold the conference.
