GUWAHATI: In a major relief to the teachers' fraternity of the state, the Gauhati High Court in order has stated that it agrees to the submission made by the Advocate General of the State that the RIIMS application is not required to be downloaded in the mobile of individual teachers and students. Hearing a petition filed by several teachers' associations of the state on December 22, the court of Justice Kalyan Rai Surana said that it agrees with the submission made by the Advocate General in the Court which mentioned that the registration of the teachers would be required to be done only in the official app downloaded by the school and such application are "not required" to be individually downloaded by the teachers.
"The learned Advocate General, upon instruction, has submitted that as per his instruction, the RIIMS App is required to be downloaded in one registered mobile, which would either be operated by the Headmaster of the Government or provincialized school or any other person who may be designated for the purpose. It is submitted that the requirement of the communication dated 23.09.2021 (Annexure-1) is that one photograph of each student and the teacher would be uploaded and a designated person would be taking the photograph of the attending students and teachers at a particular designated place of the school, which is for the purpose of ensuring attendance of teachers and to prevent dropout of the students. It is stated that the registration of the teachers would be required to be done only in the official app downloaded by the school and such applications are "not required" to be individually downloaded by the teachers, the order said.
The order further mentioned, "The Court is of the further considered opinion that the State Government, in the concerned Education Department, who are providing education in the Government or provincialized schools have a right to have attendance taken in such a manner they so desire, so long it does not infringe with the personal liberty of the teachers, which appears to be well-founded because the RIIMS is not required to be downloaded in the mobile of individual teachers and students."
"In view of the specific stand taken by the learned Advocate General that individual teachers are not required to have RIIMS App downloaded in their personal mobile and that such information would be collected only by the registered mobile, which may be handled by any authority of the school, the Court is of the considered opinion that no interim order is called for at this stage," the Court said in its order. The next hearing has been listed on January 19, 2022.
