Gauhati High Court directs P&RD Department to pay minimum pay scale to casual workers

GUWAHATI: The Gauhati High Court has directed the State Panchayat and Rural Development Department to pay the minimum pay scale to five casual workers under the office of the Chief Executive Officer, Kamrup Zilla Parishad, within a period of two months.

The five casual workers (petitioners) were appointed as Tax Collectors/LDA in different gaon panchayats in the office of the Chief Executive Officer, Kamrup Zilla Parishad, Guwahati. They were not paid the minimum pay scale as per the judgment and order dated 08.06.2017, passed by the Division Bench of the Gauhati High Court in writ appeal No.45/2014. Feeling dejected, they approached the Gauhati High Court and filed a writ petition (WP(C)/4285/2021) seeking minimum pay scale of Rs 15,900 per month along with allowances and also for payment of arrear salary for the period from 01.08.2017 to 30.11.2018.

The Finance Department, Government of Assam, informed the court that on instructions, the case of all the five petitioners had been approved by the department for payment of minimum of the pay scale by order dated 10.09.2021. The court, after considering the letter dated 10.09.2021, written by the Commissioner & Secretary to the Government of Assam, Finance Department, disposed of the writ petition and directed the State Panchayat and Rural Development Department and the Chief Chief Executive Officer, Kamrup Zilla Parishad, to "immediately take steps in terms of the letter dated 10.09.2021 and pay the minimum of pay scale to the petitioners within a period of two months". The court also directed to pay the arrear salary of the petitioners for the period from 01.08.2017 to 30.11.2018 at the earliest.
