Remission of Sentences of Prisoners By Assam Government

GUWAHATI: In commemoration of the ensuing Republic Day, 2019, the Assam Government has decided to remit the sentences against certain categories of prisoners who have been convicted by the Courts (other than Court-martial) having original jurisdiction in the State of Assam.

The Government is pleased to grant remission of sentences to the different categories of prisoners for the periods as specified below lodged in the jails of Assam and outside other than those in respect of whom the sentence is inflicted for an offence against the order or is passed under any law relating to which the executive powers of Unions extend. The scales of remission of sentence for different categories are:

Prisoners with sentence above one year will get a scale of remission of 30 days; Prisoners with sentence above 6(six) months up to 1 (one) year will get 15 days; Prisoners with sentence above 3 (three) months up to 6 (six) months will get 10 days; Prisoners with sentence above 1 (one) months up to 3 (three) months will get 5 days.

It may be mentioned that the aforesaid remission granted under this order shall not be admissible to the following categories of prisoners namely., Prisoners sentenced to simple imprisonment in lieu of fine; The Foreigner Act; The Passport Act; Foreign National convicted under any Act; Section 3 to 10 of the Official Secret Act, 1923; Prisoners convicted for offences against the State under section 121 to 131 of I.P.C, Prevention of Corruption Act; Section 107/109 Cr. P.C; Offences to which executive power of the Union extends; Prevention of Food Adulteration Act; Suppression of Immoral Traffic Act; Prisoners convicted under the Narcotic Drugs & Psychotropic Substances Act 1985 (NDPS Act); Prisoners convicted for the offence of “rape”. The remission order will take effect on January 26, 2019, as stated in a press release.
