CM's Special Vigilance Cell submits part charge sheet against Saibar Rahman in DA case

GUWAHATI: Assam Civil Service (ACS) officer and former Additional Deputy Commissioner of Dhubri, Saibar Rahman was granted default bail by the Gauhati High Court on Tuesday in the disproportionate assets (DA) case (03/2021) registered against him by the Chief Minister's Special Vigilance Cell.

While hearing the bail application (Bail Appln./2496/2021), Justice Hitesh Kumar Sarma stated, "In the considered view of this Court, the petitioner is entitled to the grant of default bail in view of the admitted position that charge sheet was filed beyond 90 days resulting in accruing an indefeasible right to bail. Hence, the petitioner is granted default bail. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with the case aforementioned on furnishing bail bond of Rs 1,00,000 with two suitable sureties of the like amount, to the satisfaction of learned Special Judge, Assam."

Saibar Rahman was arrested in August by the CM's Special Vigilance Cell on the charge of acquiring property disproportionate to his known sources of income, through 'corrupt' means.

Meanwhile, the CM's Special Vigilance Cell submitted the part charge sheet of 92 pages in the DA case (03/2021) of Saibar Rahman on Tuesday u/s13 (1)(a)(b)/ 13 (2) of PC Act vide CS no. 01/2021 dated 23.11.2021. The part chargesheet was submitted in the court of the special judge.

Reacting to the news of Saibar Rahman being granted default bail, Superintendent of Police of the CM's Special Vigilance Cell, Rosy Kalita, while talking to media persons, said, "There has been no delay on our part in submitting the charge sheet. According to us, 90 days is not over. Many of our officers tested positive for COVID-19 in the last few days. Our office was declared a containment zone. The investigating officer (IO) in this case also suffered from COVID-19. Despite these problems, the fact that we could submit a 92-page part charge sheet is commendable. We are going through all evidence carefully as we do not want to leave any loopholes in this case."

While Rahman was granted default bail in the DA case, he will not be walking out of jail as the Gauhati High Court on Tuesday rejected his bail plea in another case (05/2021) registered against him by the Chief Minister's Special Vigilance Cell related to anomalies in the appointment of gaon burahs. While hearing the bail plea in this case (05/2021) registered against Saibar Rahman under Sections 120(B)/420/468/ 471/384 of the Indian Penal Code, read with Section 13 (1)(a)/13(2) of the Prevention of Corruption Act, 1988, Justice Hitesh Kumar Sarma stated, "On consideration of the entire materials placed before this Court including those in the case diary as well as the submissions made by the respective counsel for the parties, this Court is of the view that considering the stage of the investigation of the case, a detail and thorough investigation appears to be necessary and, therefore, the prayer for bail of the petitioner is rejected at this stage. The bail application stands disposed of accordingly."

On the other hand, according to sources, investigation is going on in another case registered against Saibar Rahman by the Enforcement Directorate (ED). Also, there has been another complaint against Rahman in a land-related dispute and a case may be registered against him in this connection.

Meanwhile, the name of a former Deputy Commissioner of Dhubri has surfaced during the investigation in the case (05/2021) registered registered against Saibar Rahma by the Chief Minister's Special Vigilance Cell related to anomalies in the appointment of gaon burahs. The former DC has been asked to appear before the CM's Special Vigilance Cell on November 27, 2021 for interrogation.
