Consumer Court ordered to pay compensation Samsung India

GUWAHATI, July 7: The District Consumer Disputes Redressal Forum, Kamrup ordered Samsung India to pay compensation Rs. 14,200 to bajyoti Pathak. The Redressal Forum also ordered to pay the compensation amount within 45 days to the complaint.  The complaint, senior jourlist bajyoti Pathak purchased a Samsung Mobile set on  August 28, 2008. A few days after the purchase it was noticed that Mobile set was not working properly, showed erroneous performances. The matter was brought to the notice of the mobile shop from where the complaint purchased it, but with no results. On May 10, 2009 the Mobile set was not working at all and the set was handed over to Samsung Servicing Centre, Guwahati. After checking up the mobile the servicing centre gave him an estimate of Rs 2787.2 for repairing of Mobile set. The mobile set was in very much within the warranty period. As per the warranty card, the Samsung India has to repair/replace the mobile set free of cost. The fact was rrated to the company but they fail to do anything for redressal of his grievances. The cost of the mobile set was Rs.5,200, and claiming Rs 2787.2 as cost or repair which is above 50% of the cost price and that too during the warranty period is very much unreasoble.  Thereafter the complaint bajyoti Pathak filed a complaint with the Consumers' Legal Protection Forum, a consumer rights body, against the Samsung India for their negligence and full violation of warranty condition.
