“Never play with the Supreme Court’s order”: The Apex Court to M Nageswara Rao

Guwahati: Senior CBI officer M Nageswara Rao was summoned by the Supreme Court on Thursday over the transfer of officer A K Sharma. Notably, A K Sharma was probing the Bihar shelter home cases. The Apex court has called it a contempt of court.

The SC, after summoning the former interim director of CBI Rao has asked him to be present in the court on February 12. The respected court has also directed the CBI to identify the officers who were involved in the transfer of Sharma.

Chief Justice of India Ranjan Gogoi speaking to Rao, said, “We are going to take it very very seriously. You have played with the order of Supreme Court of India. God help you. Never play with the Supreme Court’s order.” CJI Gogoi made the direction after coming to know that two CBI officials including M Nageswara Rao were involved in the case of transferring Sharma.

This was being clearly ordered by the court that A K Sharma, who is associated as the senior most supervising officer in Bihar Shelter home cases, should not be transferred until the cased is solved. But going against the order of the court, Rao and another officer made Sharma’s transfer order. Hence, this clearly is a contempt of court and this makes the SC summon Rao.

Further, on January 17, 2019, Sharma’s tenure in CBI was shortened. Eventually, Sharma was moved out as ADGP CRPF.

The Supreme Court bench of judges was headed by Chief Justice Ranjan Gogoi. The bench has clearly directed that the transferring the CBI officer is a violation of its order and hence, the bench asked the investigating agency to file an explanation including an affidavit.

Supreme Court also told Bihar, “Enough is enough. Children cannot be treated like this. You cannot let your officers treat children this way. Spare the children.”

It further asked whether the Appointments Committee of the Cabinet (ACC) was informed that by the government that there was an restriction on Sharma’s transfer as per an order of the court.
