Delhi High Court Declares OPS For All CAPF Personnels

NEW DELHI : The Delhi High Court declared that all employees of the paramilitary force will be provided access to the old pension scheme (OPS). This particular step is being taken, as the court views the central armed police forces (CAPF) as a part of the armed forces of the union government. 

The CAPF should enjoy the perks pension just like any other army, air and navy force. On Wednesday, justice Suresh Kait along with Neena Krishna Bansal, based on Article 246 of the Indian constitution stated that, all forces of the union government including Naval, Military and Air forces should be given access to the OPS.

Hence, CAPFs being an integral part of the Union in India, deserve to get the benefits as well, in regards to notification issued by the ministry of home affairs in December 2003.

The bench of justices announced that CAPFs will not be granted the new pension scheme as stated in the notification of 2003. The New Contributory Pension Scheme (NPS) came into existence on 1st of January, 2004.

The judgement was passed on based on several petitions filed by personnels of Central Reserve Police Force (CRPF), Sashtra Seema Bal (SSB), Border Security Force (BSF), Central Industrial Security Force (CISF) along with the Indo Tibetian Border Police (ITBP).

A total of 82 petitions has been received by the court in relation to access to OPS. Advocate Ankur Chibber stated on behalf of the petitioners that, inspite of the fact the apex court has declared that CRPF is an armed force of the union of India, the respondents are not considering the petitioners under OPS, unlike the army, navy and air forces.

The court in the favour of the petitioners announced that not just the personnels who filed the appeal but all individuals employee in CAPFs shall get the access to old pension scheme.
