Delhi High Court orders ban on selling of medicines through e-commerce portals

Guwahati: The new Delhi high Court directive of putting a ban on the sale of medicines through e-commerce portals has come as a blow. Notably, as per the high court order, the ban will be applicable to the selling of medicines all over India.

The leading online medicine selling sites like those of Practo, 1MG, Netmeds, WeChemist, and others are going to suffer major losses after this new order by the Delhi HC.

A bench of Chief Justice Rajendra Menon and Justice V K Rao passed the order on a PIL filed by a Delhi-based dermatologist, states a media report.

The PIL filed by the dermatologist expressed concern over the unregulated and uncontrolled sale of medicines on the internet. There are lakhs of medicines that are being sold through e-pharmacies every day and this might pose as a huge risk to the patients and doctors.

Another factor mentioned in the plea states that as per the Drugs and Cosmetics Act, 1940 and Pharmacy Act, 1948, the online sale of medicines is actually not permitted and this is illegal. It states, “Unlike common items, drugs are highly potent and its misuse or abuse can have serious consequences on human health.”

Another order passed by the Ministry of Health in September had banned the manufacture for sale or distribution of 328 fixed-dose combinations (FDC) drugs and this order was implemented with immediate effect. What is more, this order had restricted the manufacturing, selling or distribution of six FDCs subject to certain conditions.
