Five-year rigorous imprisonment & fine for Excise Superintendent Jibon Phukan

GUWAHATI: One Dipanita Dowara of Bongaon, lodged a written complaint on June 29, 2016, stating that she looks after a wine bar of her sister Pariniita Dutta. As Parinita Dutta is physically not sound to look after the wine shop, Dipanita Dowara had submitted a petition to the Deputy Commissioner Golaghat through the Superintendent of Excise, Golaghat for permission for shifting the wine shop to 200 metres away from its original location by the side of the National Highway as per verdict of the Supreme Court. But accused Jibon Phukan, the then Superintendent of Excise of Golaghat Dist, demanded bribe of Rs 30,000 to do the job. However, later he reduced the bribe amount to Rs 25,000.

As per the complainant, Dipanita Dowara was not willing to pay any bribe, so she lodged a complaint with the ACB Police Station, Guwahati and accordingly ACB PS case No 05/2016 U/S 7/13(1)(d)(ii)/13(2) P.C Act, 1988 was registered.

During the course of investigation, a Trap Team was constituted on June 30, 2016 and accused Jibon Phukan, Superintendent of Excise, Golaghat was caught red-handed at his office while he was taking a bribe of Rs 25,000 from the complainant Dipanita Dowara. Accused Jibon Phukan, Superintendent of Excise, Golaghat was arrested and forwarded into Judicial Custody on July 1, 2016.

After completion of the investigation, Charge Sheet was submitted on July 12, 2017 against him and during trial 17 (seventeen) Nos of Prosecuting witnesses were examined before the Special Court, Guwahati.

On conclusion of trial, Gautam Baruah, AJS, Special Judge, Assam, Guwahati has on Friday convicted and sentenced the arrested accused Jibon Phukan, the then Superintendent of Excise, Golaghat to undergo rigorous imprisonment for 5 (five) years and to pay a fine of Rs 50,000 for his offences committed U/S 7/13(1)(d)(ii) R/W sec. 13(2) of P.C Act, 1988 and in default to further undergo RI for one year.
