Five-year rigorous imprisonment for rape attempt

DIBRUGARH, February 25: A person was sentenced to five years of rigorous imprisonment on charges of attempt to rape of a minor girl.

The Assistant Sessions Judge of Dibrugarh, N Akhtar, convicted Jatin Das alias Kania Das (30) and sentenced him under section 376(2)(f)511 with a rigorous imprisonment for five years and imposed a fine of Rs 5,000.

Default in the payment of fine would increase the duration of imprisonment by six months. The accused was sent to jail custody to serve out the sentence.

However, he has a right of appeal at a higher court of law. The accused Jatin Das alias Kania Das, son of Akan Das, a married man of Kawoimari Gaon under Barbarua Police station tried to rape a girl of around nine years at his house on August 19, 2008 in the absence of his wife. But he fled after his wife arrived suddenly. On hearing the facts from the minor girl, the father of the victim lodged an FIR in Barbaruah Police Station. On the basis of FIR, police registered a case (115/2008 under section 376(2)(f) IPC and accordingly police submitted the charge sheet against the accused after thorough investigation.

After considering the evidence on record, the court found that it was a case of an attempt of rape on a minor girl by accused.
