Gay Sex No longer a Crime in India : Supreme Court on Section 377

New Delhi: In what might be regarded as a historic decision, the Supreme Court of India on Thursday decriminalized the much-debated section 377, thus making consensual gay sex a legal affair.

The 5-judge bench of the Supreme Court after hearing a batch of pleas against the 158-year-old colonial law of Section 377 of the Indian Penal code that criminalizes gay sex even consensual ones.

Chief Justice of India Dipak Mishra said," LGBT Community has same rights as of any ordinary citizen. Respect for each other's rights and others are supreme humanity. Criminalising gay sex is irrational and indefensible".

The Supreme Court bench beside CJI Mishra consists of Justices R F Nariman, A M Khanwilkar, D Y Chandrachud, and Indu Malhotra.
