Tripura High Court public prosecutor resigns to avoid action

Agartala, March 16: The Public Prosecutor in the Tripura High Court Abhijit Ghosh submitted resigtion following allegations of violating the brief and arguing in favour of a bail petition submitted by 12 persons convicted by the lower court for their involvement in the sensatiol murder of former Congress MLA Parimal Saha.

Tapan Chakraborty, the law minister informed the state assembly that Ghosh has submitted his resigtion following an investigation order issued by the state government.

Tripura Pradesh Congress president Birajit Sinha, MLA, first drew the attention of the assembly few days back about the misconduct of the public prosecutor. He said PP remained silent while the case came for hearing and told the court that he has no objection if bail is granted.

The law minister initially rejected the allegation but the issue took a new turn when division bench comprising Chief Justice T Vaipai and Justice S C Das in their judgement expressed surprise over the PP’s conduct.

The issue got further complicated when it came to fore that in another case he argued in favour of a bail petition submitted by a Tripura Civil Service officer Pan Ahemad who was accused of raping a housewife.

Pan Ahemed was a prominent leader of the CPI(M)’s students wing the Students Federation of India before joining the service.

Birajit Sinha along with other MLA’s Ratan Lal th and Gopal Roy again raised the issue in the house on Wednesday and demanded action against the PP forcing the state government to order investigation. A show cause notice also was served to the PP.

The Law Minister told the house that the controversy came to an end following the resigtion of the PP but it failed to satisfy the opposition MLA’s. They cited several Supreme Court order regarding similar matter and demanded action against the Public Prosecutor.  Gopal Roy said all the killers of Parimal Saha were front ranking worker of the ruling CPI(M) and the Public Prosecutor played a suspicious role in the court following instruction of the party.
