GUWAHATI: A First Information Report (FIR) has been lodged against Rahul Gandhi in Guwahati, Assam concerning his comments about the Indian state. The complaint, submitted at the Pan Bazar Police Station, contends that his statements represent a danger to national integrity and security. This complaint cites sections 152 and 197(1)d of the Bharatiya Nyaya Sanhita, which relate to actions that might jeopardize the sovereignty and unity of the nation.
The complainant was Monjit Chetia who accused Gandhi of crossing the boundary of free speech. He was of the view that his statement was a grave threat to the public order and national security. Chetia's complaint centered on the statement of Gandhi saying he would fight against the "Indian state itself," which Chetia stated could incite subversive activities and rebellion among citizens.
Chetia further added that Gandhi's statement is an expression of frustration because of the electoral defeats Congress has been suffering, and he is trying to undermine the state's authority by creating a story that may incite unrest and separatist sentiments.
This highlighted the role of the Leader of the Opposition to guard public trust in democratic institutions, which he claimed Gandhi was misusing for the purpose of spreading false information and creating disaffection against the central government.
Gandhi made these remarks during the inauguration of the Congress party's new headquarters in Delhi, responding to comments by Mohan Bhagwat, the head of the Rashtriya Swayamsevak Sangh, regarding India's "true independence."
