Assam Woman Sent To Judicial Custody For Allegedly Registering False Rape Case

Guwahati: A court in Assam's Hailakandi district has sent a lady to judicial custody for allegedly lodging a false First Information Report (FIR) claiming she has been raped.

As per a report by India Today NE, following the false FIR which misled the court, a case was registered against her under sections 193 and 195 IPC.

After the case was registered, the lady was taken into custody following the order of the Additional Sessions Judge and was produced before the Chief Judicial Magistrate.

Notably, over the complaint of the lady, a case was registered under sections 448 and 376 IPC against a person who was accused of raping her.

However, after the court learned that whatever information has been put forward by her in front of the court is baseless and false, the court took cognizance of the same and sent her to judicial custody.

As per the report, it came to the fore that the rape accused person urged the court to initiate a proceeding against the complainant as she was having a grudge out of a land dispute.

"Offence of rape is serious in nature. Whenever any such incident is reported, humanity as a whole starts raising protests against such barbarous acts and society demands severe punishment against the wrongdoers. Sometimes, it is felt that some false cases are also filed and for which, the lives of many male persons get spoiled. Court of law is established to deliver justice to the person whose rights have been infringed," India Today NE quoted the court order as saying.

"The court or police authorities can't be used as a tool of oppression to others. Justice demands that whoever abuses the process of law should also get a lesson so that the similar-minded person in the society would be deterred from such acts in future." the court order further read.
