Gauhati High Court to Hear Plea: Man from Dubai Seeks Access to Ailing Mother in Assam

GUWAHATI: In a heartfelt plea, Nitin Agarwal, originally hailing from Assam but currently residing in Dubai, has resorted to the Gauhati High Court to secure access to his 80-year-old ailing mother, Vidya Devi. A family dispute with his elder brother, Vinay Kumar Agarwalla, who resides in the Nagaon district of Assam with their mother, has left Nitin in a desperate situation.

Nitin's ordeal began when his mother's health deteriorated significantly, and doctors in Dubai advised him to move her to India due to limited insurance coverage. Struggling to manage her care in Dubai, Nitin entrusted his elder brother, Vinay, with the responsibility of providing their mother with the necessary medical care and support at their home in Nagaon, Assam. Nitin also assured financial assistance to his brother for this purpose.

With time, their mother's condition worsened, leading Nitin and his wife to bring her to New Delhi for advanced medical treatment in October 2022. Nitin temporarily arranged for her to stay at an old age home with a full-time nurse in New Delhi before leaving for Dubai. He informed his brother of the arrangement, expecting that his mother would eventually return to Nagaon, Assam.

However, after Vinay took their mother back to Nagaon, he seemingly cut off all contact between Nitin and their mother, leaving Nitin in the dark about her well-being. Helpless and worried, Nitin appealed to the Nagaon deputy commissioner to allow him to communicate with and visit his mother. The deputy commissioner redirected his request to the local police station without specifying a date, resulting in no effective resolution.

Frustrated and desperate to reunite with his ailing mother, Nitin sought legal intervention, approaching the Gauhati High Court in Assam. In his plea to the court, Nitin Agarwal detailed the emotional ordeal he faced due to his elder brother's alleged refusal to allow him to meet or even speak to their ailing mother.

The Gauhati High Court, after hearing Nitin Agarwal's plea, issued notices to his elder brother Vinay Kumar Agarwalla, the Nagaon deputy commissioner, Assam's chief secretary, the Director-General of Police, and the Nagaon Superintendent of Police. The court is now awaiting their responses regarding Nitin's request for access to his mother.

The next hearing on this heart-wrenching family dispute has been scheduled for November 7, 2023. The case highlights the challenges faced by families separated across borders and legal systems and the emotional toll such situations can take.
