Unrestricted sale, purchase, bursting of high-sound emitting firecrackers prohibited

LAKHIMPUR: The Directorate of Revenue Intelligence, Government of India, through an order vide No. 50/13/2014-CI(Pt) /4837 dated October 19 has raised concern over illegal import of fireworks by concealment or mis-declaration leading to harmful effect on domestic industry as well as on public health and safety.

In the meantime, the Joint Secretary to the Government of Assam, Home and Political Department, has also issued direction vide order No. Pl.A.389/2013/cCF-31027/183 dated November 6 for curbing of illegal import and sale of foreign origin fireworks and to promote only green fireworks during the festival season.

On the other hand, the Pollution Control Board, Assam has issued direction through its order released vide No. WB/GB/G-560/Pt-1/13-14/274 to comply with the judgment of the Supreme Court wherein complete ban on bursting sounds emitting fire-crackers between 10:00 pm and 6:00 am and sale or use of fire-crackers generating noise level exceeding 125 decibels (Al) or 145 decibels (C)pk at 4 meters of distance from the points of bursting was prohibited.

Under such circumstances, Deputy Commissioner-cum-District Megistrate of Lakhimpur, Dr. Jeevan B. has issued prohibition on unrestricted sale, purchase and bursting of high sound emitting fire-crackers by promulgating 144 CrPC across the district through an order released vide No. LMJ.3/2019/48 dated November 9. Through the order, the district administration has prohibited usage, sale and possession of fire-crackers of foreign origin and allowed the sale of only green fire-crackers of Indian origin. Manufacture, sale and use of fire-crackers generating noise level exceeding 125 decibels (Al) or 145 decibels (C)pk at 4 metres of distance from the points of bursting is also prohibited. Through the same order, the district administration has also prohibited the bursting of fire-crackers between 10:00 pm to 6:00 am, display and throwing of fire-crackers, bombs. in public places, on running and stationary vehicles as well as on animals and use of fire-crackers in and around sensitive zones like hospital, court premises, religious places etc. This order has come into force across the district and it will remain in force until the Deepavali and Kali Puja festivals are over. Any violation of these prohibitions will invite penal action under 188 of Indian Penal Code, the order stated.
