GUWAHATI: In a significant development, the Government of Assam has issued a fresh notification revising restrictions on land transactions in three regions-Barpeta town areas, within a five-kilometre radius of Batadrava Than in the Nagaon district, and the entire district of Majuli.

Earlier orders imposed a complete freeze on land sale permissions and mutation processes in these three areas, as per a series of office memorandums (OMs) beginning September 6, 2024, and extended until May 2025. However, following a comprehensive review, the governor has now allowed certain exceptions or relaxations. The relaxations are that (i) mutation by inheritance is now permitted without restriction in the specified areas.

(ii) Mutation by registered deed will be allowed if both the buyer and the seller are 'original inhabitants' of the area concerned.

The governor's notification defines 'original inhabitants' as individuals and their families who have been residing in the area for at least three generations. For this purpose, a generation is defined as a span of 25 years.

(iii) Land sale permissions will be granted where both parties involved in the transaction are original inhabitants.

These revised guidelines have come into immediate effect and are aimed at balancing the need for protecting sensitive zones with the rights of long-standing residents.
