GUWAHATI: The Gauhati High Court revived the suo motto PIL (3/2022) as the State Government sat over the order of this court for nine months without taking any action. Reviving the suo motu PIL, the bench comprising Chief Justice Sandeep Mehta and Justice Susmita Phukan Khaund gave the government a period of three weeks to file its response to the order. The Court re-notified the suo motu PIL for hearing on October 5, 2023.

The High Court registered the suo motu PIL on the basis of the allegation that the personnel of the Batadraba Police Station had bulldozed the house belonging to one of the citizens of Nagaon in 2022.

On January 3, 2023, the Advocate General of the State Government informed the Court that a committee consisting of the Chief Secretary was enquiring into the incidence of bulldozing of the house and that appropriate action would be taken against the erring officers within 15 days. The High Court did expect that the state government would take appropriate action to compensate the persons affected by the illegal action of the officer. The court had closed the proceedings with the liberty to revive them merely by filing a note.

Advocate Zunaid Khalid informed the media today that he had given representations to the State Chief Secretary, the DGP, and the Nagaon DC with the order of the High Court. He further said that since his representations bore no fruit, he had to move the Judicial Registrar of the Gauhati High Court, and that led to the revival of the proceedings of the suo motu PIL today.
