GUWAHATI: Former Chief Justice of India UU Lalit said that Article 32 is the most important Article in the Constitution of India because 'it is the right remedy which is approached to the Supreme for violation of any fundamental rights'.
Justice Lalit said this today while delivering the law lecture on 'Constitutional Vision of Rule of Law: A Citizen's Perspective." He was speaking at the Platinum Jubilee celebrations of the Gauhati High Court here today.
Citing various judgements of the apex court, the former CJI said Dr. BR Ambedkar made an observation while dealing with Article 32 after it was adopted: "This is the key to the entire fundamental rights chapter and aspirations of the people."
The former CJI said, "When we say rule rather than individuals, we will be guided by certain principles. Those principles must try to attain the constitutional goals, and that's why the citizen's perspective comes in. What, according to a citizen, would be an ideal situation where legal principles, a codified law, or the approach itself must be so sacrosanct that everybody considers it to be the highest goal and wishes to attain that?"
He said, "Every individual has a right to an environment where he will be able to attain the highest potential of his life. That is what we recognise as the right to life. Every person has the right to advance in life, and what is the basic tool for such advancement? It's nothing but education. And therefore, primary education is a fundamental right of every individual."
