GUWAHATI: A division bench of the Gauhati High Court comprising Chief Justice Ashutosh Kumar and Justice Arun Dev Choudhury ordered that the non-teaching staff members of government recognized venture educational institutes would be entitled to equal treatment under the law as was extended to other government employees. They should be paid ‘a just scale of pay’, said the court, which, however, made it clear that it (the court) was not inclined to spell out what the ‘just scale of pay’ to be paid to the petitioners was.

Four writ petitions clubbed together challenge certain provisions of the Assam Education (Provincialisation of Services of Non-teaching Staff of Venture Educational Institutions) Act, 2018. The petitioners are non-teaching staff members working in various colleges, higher secondary schools, senior secondary schools, high schools, and high madrassas throughout the state. The court arrived at this order in the same principle of law applied by the High Court in directing the government authorities to pay the regular scale of pay to tutors of recognised venture schools after the petitioners attained the required qualification within the stipulated time given to them.

The bench ordered the Education Department to determine a ‘just scale of pay’ for the non-teaching staff members of recognised educational institutions within eight weeks.
