Guwahati: The Gauhati High Court was recently informed that Doyjan Bibi, wife of Abdul Munnaf, was handed over to Frontier Head Quarter, BSF, and that she was 'pushed back' to Bangladesh on May 27, 2025. The information was made available pursuant to an HC order dated June 25, 2025, wherein Central Government Counsel (CGC) B. Chakarborty was requested to obtain information from the Border Security Force, Sector Head Quarter Panbari, as to the whereabouts of Doyjan Bibi, wife of the petitioner Abdul Rejjak and not Abdul Munnaf, as stated.
The division bench of Justice Kalyan Rai Surana and Justice Susmita Phukan Khaund, in a July 18, 2025 hearing of a petition in Case No. WP(C)/3170/2025, was informed of the 'push back' of Doyjan Bibi. The matter was being heard in the petition filed by Abdul Rejjak, who has been seeking answers on the whereabouts of his wife, Doyjan Bibi, ever since she was allegedly picked up from their home in Chirang district on the night of May 25, 2025-without an arrest memo, warrant, or production before a magistrate.
In the instant hearing, B. Chakraborty, CGC, produced a copy of instructions received from the Frontier Head Quarter, BSF, Guwahati, wherein it has been stated that on the request of the Assam Police, amongst others, Doyjan Bibi, wife of Abdul Munnaf, was handed over to them, and her name appears at Sl. No. 27 of Appendix - A, who was sent back to Bangladesh from the Area of Responsibility (AOR) of Ad hoc 2503 Bn. BSF, Dhubri, on May 27, 2025.
In response to this, Mrinmoy Dutta, counsel for the petitioner, submitted that he has received specific instructions that the petitioner, namely, Abdul Rejjak, is the husband of Doyjan Bibi, and therefore, he requires the whereabouts of his wife, Doyjan Bibi, wife of Abdul Rejjak, not Doyjan Bibi, wife of Abdul Munnaf.
The Court, during the hearing today, noted that the BSF documents suggested Rejjak's alias was Abdul Munnaf. But petitioner's counsel Mrinmoy Dutta categorically denied this, saying, "I do not use or acknowledge any other name. In earlier court filings, including petitions filed by Doyjan Bibi herself, she clearly stated that her husband is Abdul Rejjak. There is no alias."
The instructions produced by the CGC were returned by the HC with a request to provide a copy of relevant instructions to G. Sarma, Standing Counsel for the FT matters, so as to enable him to obtain instructions about the whereabouts of Doyjan Bibi, wife of Abdul Rejjak, against whom an ex-parte opinion dated August 31, 2017, was passed by the Member, Foreigners Tribunal 4th, Dhubri, Assam, in F.T.C/No.FT-4/71GPR/2017, arising out of Ref. C/No. IM(D)T 806/98.
