GUWAHATI: The Gauhati High Court has directed the Director General of Police (DGP), Assam to entrust the investigation of Santush Hojai kidnap and murder case with the Criminal Investigation Department (CID). The High Court has further said that 'in case the investigation is entrusted with the CID, Assam by Director General of Police, the Special Investigation Team (SIT) shall stand disbanded'.

The case (WP (Crl)(Suo Moto) 1/2020) was based on the letter written by petitioner Jayanta Hojai. The letter has been treated as a Habeas Corpus petition.

It was at 6 pm on April 24, 2020 Santush Hojai was kidnapped from his residence at Harangajao.

In its earlier order, the High Court directed the DGP "to make sure that a team is constituted for tracing the whereabouts of Santush Hojai and ensure that an affidavit of a responsible officer, not below the rank of a Superintendent of Police, is filed before this Court on May 4, 2020".

In the meantime, on May 2, 2020 the High Court received information from the petitioner that the body of Santush Hojai had been recovered on April 30, 2020. On May 4, 2020, the High Court directed that at every stage of the investigation, scientists from Forensic Science Laboratory would be involved.

During the listing, D Saikia, learned senior counsel informed the Court that an SIT led by DIG (SR) Dilip Kumar Dey had been constituted.
