
Despite suspension by the party, MLA Ali was the proposer of INC’s RS candidate and cast a vote: Speaker

GUWAHATI: Assam Legislative Assembly Speaker Biswajit Daimary today rejected the petitions of Leader of Opposition Debabrata Saikia and MP Rakibul Hussain, who had sought the disqualification of Congress MLA Sherman Ali Ahmed as a member of the august House. The Speaker found both the petitions were devoid of merits.
The Speaker said that, despite being a suspended member of the Congress, MLA Shermal Ali Ahmed was the proposer of the Congress’ Rajya Sabha candidate and voted on the basis of the three-line whip of the party in the election held on March 31, 2022.
Rejecting MP Hussain’s petition that sought disqualification of Baghbor MLA Sherman Ali Ahmed, the Speaker said, “…Every political party has its own constitution and ways to deal with indiscipline. In the instant case, the concerned political party itself has not taken enough action as per their constitution against the MLA. As such, it cannot be presumed that the party is against the MLA, or it might have condemned the action of the MLA. Thus, in the facts and circumstances of the case and in law, I do not find that the respondent has done any such act, which comes within the purview of the provisions of the Tenth Schedule of the Constitution of India… I find that the petitioner has not been able to establish the contentions made in the petition, and the same stands rejected.”
On the rejection of the petition of Leader of Opposition Saikia, the Speaker said, “The respondent (MLA Sherman Ali Ahmed) cannot be disqualified from being a member of the Assam Legislative Assembly under the provision of the Tenth Schedule of the Constitution of India. The application filed by the applicant has no merit and is hereby dismissed.”
