GUWAHATI: The Gauhati High Court has directed the authorities concerned to keep 27 posts in five polytechnic institutions of the State out of the purview of the recruitment process of 80 lecturers which was started via an advertisement dated June 4 last, in case these posts have not been already exempted from the process.

The court issued this interim directive in response to a Writ Petition filed by 27 lecturers who have submitted that the latest recruitment-related advertisement, if it has not exempted their posts, would result in irreparable loss for them as there will be no such vacancies/posts for regularization of their services.

The petitioners informed the court that they were recruited as lecturers in the newly-established polytechnic institutes in the districts of Chirang, Hailakandi, Morigaon, Tinsukia and Udalguri in pursuance of an advertisement issued in 2020 by the Director of Technical Education.

Subsequently, in pursuance of departmental notifications dated December 15, 2021 and February 22, 2021 as well as the decision of the Cabinet taken on November 24, 2021 the Higher Education (Technical) Department of the State gave ex-post facto approval of the petitioners' appointment with effect from the respective dates of their joining service. The court was further informed that only the order regarding regularization of their services is required to be issued by the APSC as well as the Higher Education (Technical) Department.

However, the petitioners submitted, in the meanwhile the Chairman of the Assam Engineering Services Recruitment Board issued an advertisement for filling up 80 number of post of lecturers in different branches of the Government polytechnic institutes of the State. In case these 80 posts include the 27 posts held by the petitioners, then it would be prejudicial to their interest, the petitioners contended.

Thereupon, while serving notices returnable by eight weeks, the High Court made it clear that in the interim, the 27 posts involved in the case will be kept out of the purview of the 80 advertised posts of lecturers, in case it has not been done.
