NEW DELHI: The Supreme Court dismissed several review petitions challenging its October 2023 ruling in the same-sex marriage case, on Thursday. A bench consisting of Justices BR Gavai, Surya Kant, BV Nagarathna, PS Narasimha, and Dipankar Datta reviewed the petitions concerning the matter in chambers.

The new bench was formed after Justice Sanjiv Khanna, the current CJI, recused himself from hearing the review petitions on July 10. Significantly, Justice PS Narasimha is the sole member remaining from the original five-judge Constitution bench that delivered the verdict, as former CJI DY Chandrachud and Justices SK Kaul, Ravindra Bhat, and Hima Kohli have retired.

The judgment delivered on October 17, 2023, by a 3-2 majority, refused to grant legal recognition to same-sex marriages or civil unions, asserting that the matter was within the legislative domain. The majority opinion, authored by Justices Bhat, Kohli, and Narasimha, concluded that granting the right to marry or form civil unions for queer couples was not a constitutionally protected mandate.
