Kokrajhar: Coming down heavily against the formation of BTAD Army by Kokrajhar MP Naba Kumar Sarania, the president of Bodoland Janajati Suraksha Mancha (BJSM) on Friday made it clear that the non-tribals could not have equal political rights in 6th schedule tribal council as councils are formed for the protection of indigenous tribal people.
The president of BJSM Janaklal Basumatary said BTC was four districts of 6 schedule tribal area administration of Assam created in 2003 by Union legislature where land rights and political rights are reserved for tribal people for their protection of life and property, language, culture, custom, tradition, religious beliefs and economic exploitation from their more advanced majority aggressive non tribal community counterpart suffered since time immemorial, and to develop, promote, user welfare for their language, culture, customs, tradition, economy, education, religion, in other words to progress with own identy. He said the land and political rights were reserved for tribal people in 6th schedule tribal area administration in Assam under Article 244 (2) of the Constitution of India. Before creation of BTC under 6th schedule tribal administration, land and political rights were reserved in tribal belt and blocks notified area for land under X chapter provision inserted in 1947 in Assam Land and Land Revenue Regulation Act, 1886 and some constituency reserved for MLA, one constituency for MP for political right reservation under Article 330 of the constitution respectively.
BJSM president Janaklal Basumatary said that no non-tribal, non protected class of people can acquire or transact land property after 2003 in 6th schedule tribal area administration districts and in tribal belt and blocks area after notification for it in 1947 and subsequent amendments from time to time except those non-tribal people who are living before tribal belts and blocks notification years. These reservations are provided consciously by making exception in Fundamental Rights of equality and equal opportunity for all under Art. 15(4) and 16(4) of the Constitution of India for their being weaker section of the society under Art. 46 of the Constitution. So no non-tribal, non protected class of people can claim equal rights in the 6th schedule tribal area administration or administration of tribal belt and block area, he said adding that there was no question of maintaining security for life and property for non protected advanced non-tribal community people in BTC tribal area; 6th schedule administration has no right to acquire property or transact land property and acquire business.
The illegal dangerous act of non protected, non-tribal class of people against the protected tribal people can be booked criminal case under Prevention of Atrocities of SC/ST Act. 1979 against the non tribal leaders in BTC. So, non tribal leaders of this illegal political party and BTAD Sena Naba Kr. Sarania, Abdul Badshah Khan and Brajen Mahanta can be booked under this Act. for preparing blatant invasion of notified tribal land and tribal administration, he said adding that the Gana Suraksha Party is other name of Oboro Suraksha Samity whose sole aim is to snatch all the constitutional safe guards of Boro tribals as tribal community. So working against Boros means working against tribals. For that Naba Kr Sarania committed double crime, he said. “One he is the main person to create illegal political party and army to work against Boro tribals in tribal notified protected area of land and reserved tribal area administration. Second, the most serious crime he has created that fraudulently obtained ST certificate as Borokachari community being non Boro, non tribal, non protected Oboro class of people . As he is Oboro means non Boro he indulges activities to destroy Boro people as tribal community and to destroy tribal constitutional institution for the sole benefit of Oboro, non tribal people to which he belongs”, BJSM president Janaklal Basumatary said
He also said it was not for destroying tribal rule of Hagrama Mahilary but it is for destroying the Boro tribal people in their notified reserved tribal land. He reiterated that Sarania had criminal enticident as surrendered ULFA still having stock of arms and ammunition to be utilized in elections by his 20,000 army. A non-tribal, non protected community can not raise any army to work to harm and to invade the protected tribal people culturally, linguistically, politically, intelectually in their protected tribal land.
Hagrama and his colleagues tribal leaders are foolishly not bothering or neglecting the result of allowing to issue ST certificate to non notified Sarania people which facilitates to rally around them by non protected, non-tribal class of people causing great concern for genuine tribal people to lose their constitutional rights, he said adding that the only solution was to stop issuing ST certificate to non notified community and declare invalid such certificate issued earlier. Then Oboro against Boro politics will die natural death and the tribal area administration will be saved from non-tribal advanced communities multifrone attack.
