Shillong: Special Investigation Team (SIT) Incharge and Shillong City Superintendent of Police Herbert Pyniaid Kharkongor on Thursday confirmed that two of the accused in the Raja Raghuvanshi murder case were produced before the Magistrate, but they declined to record any confession.

“We have not sent everyone, two of them, but they didn’t want to make any statement before the Magistrate,” Kharkongor said. He explained, “We have ample evidence, right from the beginning till now. Whatever materials we have, these are good evidence.”

Emphasizing that the investigation is not solely dependent on confessional statements, he added, “To police, confession is not admissible, but I said material evidence are very important and it is their right not to make any confessional statement.”

Kharkongor further clarified, “Not all have been sent except for two accused, Akash and Anand, but they refused. It’s not an issue.” While statements made to police under Section 161 CrPC (or Section 180 BNSS) aid investigation and cross-examination, it is statements recorded before a Magistrate under Section 164 CrPC (or BNSS equivalent) that hold substantial evidentiary value in court.

The SIT continues to await forensic reports as the investigation progresses.
