GUWAHATI: A division bench of the Gauhati High Court took up the matter of implementation of Section 12(1)(c) of the RTE Act. Based on the submissions by the parties concerned, the court directed the clearing of all pending admissions under the RTE Act within three days.

The Counsel for Education Department submitted that admissions under the RTE Act could only be made in entry-level classes and not later. The petitioners later contested the same on the grounds that the Supreme Court, along with the Office Memorandum of the State Education Department itself, provides for admission into any class under the RTE Act, not limited to class 1 or pre-primary.

The counsel for the petitioners also highlighted the need for a centralised admission portal for admission under the RTE Act and relied on a copy of a statement of purpose by the National Commission for Protection of Child Rights and directions of the Supreme Court for compliance with the said SOP (Standard Operating Procedure).

On the list of states that have active RTE portals, the Court remarked, "Assam is also doing well, don't worry. They are already in the process; let them put up a portal that is free from all glitches".

In this regard, the court directed the State Education Department to file a detailed affidavit on the steps being taken to introduce the portal.

Before the start of the hearing, the court expressed its displeasure over how much publicity was given to this case across social media and advised restraint.
