Assam: Gauhati HC spells out material details for motor vehicle accident claims

GUWAHATI: Pursuant to the directions of the Supreme Court of India in a suo moto writ petition (civil) in reference to the compensation amount with Motor Accident Claims Tribunals (MACTs) and Labour Courts, the Gauhati High Court issued some practice directions for ensuring the disclosure of material details while filing claim applications under Section 166(1) of the Motor Vehicles Act, 1988, to MACTs/courts taking up MAC cases where there is no designated MACT.

In a notification issued recently, the Registrar General of the Gauhati High Court said, “The petitioners have to incorporate their names and addresses (both local and permanent) of the injured persons or the owner of the damaged property, their Aadhar and PAN details and email ID, if any. They also need to give the names and addresses of all the legal representatives of the deceased victim of the accident who are claiming the compensation, their Aadhar and PAN details, and email ID, if any.”

The notification said that the registration of the application will not be refused on the ground of the petitioners not giving details sought. However, MACTs/courts taking up MAC cases where there are no designated MACTs may direct the furnishing of this information at the time of issuing the notice.

While passing an interim or the final order of grant of compensation, the MACTs/courts shall call upon the person or persons held entitled to receive compensation to produce their bank account details along with either a certificate from the banker giving all details of the bank accounts.

The notification also gave several other directions that make the payment compensation easier.
