GUWAHATI: The Gauhati High Court has told the State's Department of Elementary Education, the Sarba Siksha Abhiyan Mission, Assam and the National Council for Teacher Education that any recruitment of contractual upper primary and lower primary school teachers, which will be made on the basis of an advertisement dated September 18, 2021, will be "subject to the outcome" of a Writ Petition (WP(C) 526/2022) filed by 102 aggrieved teachers.

The petitioners have contended that while marks are allotted for previous teaching experience during similar recruitment processes in secondary schools, no weightage has been given to experience in the impugned advertisement for filling up 9,354 posts of contractual teachers.

Appearing on behalf of the State Government, Advocate General Devajit Saikia submitted that the relevant rules do not prescribe any such weightage for experience. He stated that the recruitment is being done strictly in accordance with the rules.

However, the counsel for the petitioners challenged the Advocate General's contention and stated that experience ought to be given weightage as per the amended rules of 2005.

The court then mentioned the proviso that the recruitment process will be subject to the final order of the court with regard to the Writ Petition filed by the aggrieved teachers.
