Deed of agreement for renting a house

The deed of house of rent agreement is made between One Part (hereifter called the first party) and the Other Part (hereifter called tent or the second party) is reached in black and white either in front of the Notary in Stamp paper costing Rs 20 or in front of the Register of agreement. The addresses of both the parties should be clearly mentioned in the deed.

The deed should make clear mention of the rent reserved and its duration, details of house or premises to be given on rent and conditions set for the second party to adhere to. The second party should pay the amount of fixed rent subject to terms and conditions that may be -

(1)    The rent created shall be paid monthly on the particular date of each month of English calendar as fixed in the deed.

(2)    The second party shall pay a sum as fixed in the deed as security deposit before entering the house or premises. The security deposit shall be refunded without interest upon expiry of the lease or on vacation of the premises by the second party any time earlier to the expirations of the rent. However, if any damage is caused to the household property by the second party, the damage has to be assessed and deducted from the security deposit.

(3)    The deed should also clearly mention that the land revenue and municipal tax in respect of the premises on rent and other charges like electricity, telephones bills etc., should be wholly paid by the second party.

(4)    It should also be clearly mentioned for what purposes - residence or office chamber or otherwise - the premises on rent shall be used.

(5)    The deed should also clearly mention that the second party shall not assign or sub-let the leasehold premises or any part of it to any person or persons or make any structural addition of the first party.          

  (6)    The deed should also mention that the second party or any other persons under the rent house shall not carry out any illegal or prohibited under the law within the said house and premises.

(7)    The deed should mention that the second party shall vacant the rent house premises and hand over peaceful vacant possession thereof along with all fittings and fixtures thereof to the first party upon expiry of the present rent deed or on ovation of the same upon determition of the tency or any other occasion whatsoever.

(8)    The period of rent may be extended by mutual consent of both the parties on such terms and conditions as may be agreed between the parties including such enhanced monthly rent etc.

(9)    The rent may be termited by either of the parties by serving a clear two months notice thereof.

(10)    In case of nonpayment of rent for any month or in the event of breach of any of the terms conditions to be observed and performed by the first party, the rent may at the option of the first party, stands termited when and in such and event the first party , shall be entitled to rent-enter into the rent house premises and to rent-posses the same without prejudice to his right to recover all arrears of rent and any damages for breach of such terms and conditions.

Both the parties have their respective sigture hereunder in the presence of at least two witnesses.
