Guwahati: In a major development to the mob lynching incident upon Guwahati boys Abhijit Nath and Nilotpal Das at Dokmoka in Karbi Anglong, all the 47 accused were framed with IPC section 302 for Murder, section 149 for Unlawful assembly to achieve common object, section 147 for Rioting and section 341 for Wrongful restraint.
The judgment was announced at the Nagaon District and Sessions Court judge Rita Kar in a hearing on the case on Saturday.
Also, 21 out of 47 accused were framed with IPC section 186 for Obstructing public servant in discharge of public functions, section 144 for joining unlawful assembly armed with deadly weapons and section 148 for Rioting, armed with deadly weapon.
One Bipul Khakhlary was charged with section 379 - Theft (stealing the wallet of the victim) of the IPC.
Reportedly, the hearing of the case was concluded by Special Public Prosecutor Ziaul Kamar assisted by senior advocate Bijan Mahajan.
Father of Nilotpal & Abhijeet, members of Abhi-Nil Smriti Raksha Samiti along with other family members was present at the hearing.
It is to be noted that the argument for handcuffing the accused was also conducted.
Until the next hearing, the order stands to handcuff the accused as there are risks of escaping and life threat involved in handling the accused.
Our advocates requested the court to consider Fast Track of the trial as directed by the high court and as per the guidelines of the Supreme Court in cases of lynching.
To which the court agreed but the defending advocate Manas Sarania objected and requested that any date of intervals between 25-30 days shall be difficult to agree upon.
Furthermore, it was finally decided that the next date is fixed on January 5, 2019, and after that subsequently the dates will be given on shorter intervals as the case streamlines.
