NRC: Is your name in the NRC Assam list? Here is the complete procedure for inclusion

The National Register of Citizens (NRC) is the register containing names of Indian CITIZENS. The only time that a National Register of Citizens (NRC) was prepared was in 1951 when after conduct of the Census of 1951, the NRC was prepared by recording particulars of all the persons enumerated during that Census. The NRC will be now updated to include the names of those persons (or their descendants) who appear in the NRC, 1951, or in any of the Electoral Rolls up to the midnight of 24th March, 1971 or in any one of the other admissible documents issued upto mid-night of 24th March, 1971, which would prove their presence in Assam or in any part of India on or before 24th March, 1971. All the names appearing in the NRC, 1951, or any of the Electoral Rolls up to the midnight of 24th March, 1971 together are called Legacy Data. Thus, there will be two requirements for inclusion in updated NRC – 1.) existence of a person's name in the pre-1971 period & 2.) proving linkage with that person. For getting their names included in the updated NRC, citizens shall have to submit Applications Forms (family-wise). Application Forms received by Govt shall be verified and based on the results of verification of particulars submitted by the citizens in their Application Forms, the updated NRC shall be prepared. However, to afford another opportunity to the applicants before publication of the final NRC, a draft NRC shall be published after verification of the Application Forms and the citizens given chance to submit claims, objections, corrections etc. After verification of all such claims and objections, the final NRC would be published.

What is National Register of Citizens (NRC)?

National Register of Citizens (NRC) means the register containing the names of Indian citizens. NRC updation basically means the process of enlisting the names of citizens based on Electoral Rolls upto 1971 and 1951 NRC.

What is NRC 1951?

National Register of Citizens, 1951 is a register prepared after the conduct of the Census of 1951, in respect of each village showing the houses or holdings in a serial order and indicating against each house or holding the number and names of persons staying therein. These registers covered each and every person enumerated during the Census of 1951 and were kept in the offices of Deputy Commissioners and Sub Divisional Officers according to instructions issued by the Government of India in 1951. Later these registers were transferred to the Police in the early 1960s.

What is National Register of Citizens (NRC) Updation?

National Register of Citizens (NRC) updation basically means the process of enlisting the names of those persons (or their descendants) whose names appear in any of the Electoral Rolls upto 1971, 1951 NRC or any of the admissible documents stipulated.

What is the background of NRC Updation?

A National Register of Citizens was prepared in 1951 after the conduct of the Census of that particular year. The Register included particulars of all the persons enumerated during that Census. As per statues governing NRC updation that are The Citizenship Act, 1955 and The Citizenship (Registration of Citizens and Issue of National Identity Cards) Rules, 2003 (As amended by 1. G. S. R. 803(E), dated 9th November, 2009 (with effect from 9/11/2009.) 2. Ministry of Home Affairs (Office of Registrar General, India), Order No. S.O. 596(E), dated 15th March, 2010, published in the Gazette of India, Extra, Part II. No. 504 S.3(ii), dated 16th March, 2010 p.1.) NRC updation process has started in Assam in 2015.

How will the NRC be updated?

The NRC will be updated as per the provisions of The Citizenship Act, 1955 and The Citizenship (Registration of Citizens and Issue of National Identity Cards) Rules, 2003 (As amended by 1. G. S. R. 803(E), dated 9th November, 2009 (with effect from 9/11/2009.) 2. Ministry of Home Affairs (Office of Registrar General, India), Order No. S.O. 596(E), dated 15th March, 2010, published in the Gazette of India, Extra, Part II. No. 504 S.3(ii), dated 16th March, 2010 p.1.). As per the two statutes, the eligibility status would be ascertained based on the NRC, 1951, Electoral Rolls upto 1971 and in their absence the admissible documents upto 24th March (midnight) 1971. The updated NRC shall contain names of persons eligible for inclusion in updated NRC by virtue of being original inhabitants of Assam.

Who are eligible to be included in the NRC?

As per the latest Order of the Hon'ble Supreme Court

WHAT IS THE LIST OF ADMISSIBLE DOCUMENTS? (The same list can be referred to by the people coming from other states of India and currently residing in Assam)

There will be two requirements for inclusion of names of any person in updated NRC–

(1) 1951 NRC OR

(2) Electoral Roll(s) up to 24th March 1971 (midnight) OR

(3) Land & Tenancy Records OR

(4) Citizenship Certificate OR

(5) Permanent Residential Certificate OR

(6) Refugee Registration Certificate OR

(7) Passport OR

(8) LIC OR

(9) Any Govt. issued License/Certificate OR

(10) Govt. Service/ Employment Certificate OR

(11) Bank/Post Office Accounts OR

(12) Birth Certificate OR

(13) Board/University Educational Certificate OR

(14) Court Records/Processes.

Further, two other documents viz (1) Circle Officer/GP Secretary Certificate in respect of married women migrating after marriage (can be of any year before or after 24th March (midnight) 1971), and (2) Ration Card issued up to the midnight of 24th March, 1971 can be adduced as supporting documents. However, these two documents shall be accepted only if accompanied by any one of the documents listed above.

(4) Bank/LIC/Post Office records OR

(5) Circle Officer/GP Secretary Certificate in case of married women OR

(6) Electoral Roll OR

(7) Ration Card OR

(8) Any other legally acceptable document

Points to remember

Providing any one of the documents of List A of ANY PERIOD up to midnight of 24th March, 1971 shall be enough to prove eligibility for inclusion in updated NRC.

Legacy Data

Legacy Data document is the database of that period which would be carrying the names of a very large number of persons together, admissible to prove the claim for inclusion in NRC updated for the state of Assam. One has to adduce the proof of residence in Assam of himself/herself or his/her ancestors prior to midnight of 24th March, 1971 for inclusion in NRC. As such the probability of finding one's name or that of the ancestors would be very high here. This would be the most commonly used document.

FILLING UP OF APPLICATION FORM

The Head of the family will fill up the Application Form for self and all the members of a family including those who may not be presently residing in Assam or, may be residing in any other state of the country or outside the country.

In the case of absence of the head of the family, any other adult member in the family can apply. In case of minor or disabled person, the head of the family or the natural guardian/ legal guardian may apply on behalf of such persons.

»

For inmates of institutional homes, orphanages, home for mentally and physically handicapped persons, old age homes etc, the head of the institution shall have to apply.

All the fields of the Application Form will have to be filled in completely and copies of Legacy Data/Legacy Data Code references/admissible documents as required will have to be enclosed by the applicant along with the Application Form.

Only photocopies of documents are needed to be enclosed. Originals shall be asked for during verification.

»

Members of the public are requested to participate in the community level meetings/Gram-Sabhas organized by the Govt functionaries in their respective areas with the objective of training and sensitizing the entire community to learn how to fill up the Application Form.

»

Intimation on such meetings shall be made public through adequate publicity measures.

»

Video clips on how to fill up the Application Forms would also be made available through web-site and other means.

»

Citizens may also visit the NRC website and call at the toll free help line number 15107 for any assistance required in filling up the Application Form.

SUBMISSION OF APPLICATION FORM

Applicants have to submit their Application Forms at their designated NRC Seva Kendra (NSK), which shall also act as the Application Receipt Centre.

»

Each NSK displays a flex banner showing details of the villages/wards under its jurisdiction. The designated NSK shall receive Application Form from the villages/wards earmarked under it. As such the public is required to acquaint themselves with their designated NSK.

»

Adequate publicity measures shall be undertaken by NRC authorities in aiding the community know their designated NSK.

»

On submission of Application Form by the public, the LRCR will check and receive the Form upon ascertaining its acceptability.

»

On receipt of a duly filled in Application Form along with required documents, the NSK Ooperator shall give the applicant a printout of the scanned copy of the Application Form with a summary of documents submitted by the applicant as Acknowledgement Receipt bearing an Application Receipt Number (ARN) & a bar code.

Only photocopies of documents are needed to be enclosed. Originals shall be asked for during verification.

»

The Application Form shall be submitted by any member of the family. However, it's compulsory for each family to submit the Form through any of its members, and not through any outsider.

»

In the most unavoidable case when the form is required to be submitted by anyone outside the family, the application will be accepted but photograph of such bearer will be captured at NSK for record and verification.

»

Application Forms can also be submitted online after registration by using the mobile number of the applicant as mentioned in the Form.

OTHER DOCUMENTS FOR SUBMISSION WITH APPLICATION FORM

To establish eligibility for inclusion in updated NRC, linkage will have to be established with the ancestor appearing in the Legacy Data/other Admissible Documents. As such, documentary proof shall have to be provided for establishing the linkage. This can be done through submission of documents, which carry the names of both the ancestor and the applicant.

Linkage documents shall be accepted even if issued after 24th March, 1971 (Midnight).

»

Linkage documents can be a Birth Certificate, Land Document, PAN Card, Board/University Certificate etc.

»

In case of absence of any documentary proof, linkage or identity shall be established through collection of other evidence by the Verification Teams.

TIMELINES FOR SUBMISSION OF APPLICATION FORM

The Legacy Data has been published in all the NSKs and notified Polling Stations/Locations on 27th March 2015.

»

Application Forms distribution has started all over Assam.

»

Applications Forms along with supporting documents will be received from public at the designated NSK till 31st August, 2015.

»

Applications can also be submitted online during this period through NRC web-site.

VERIFICATION

Verification would be consisting of two parts:

OFFICE VERIFICATION: Validation of documents submitted as proof of the claim for inclusion in NRC, which is to be done during Application Form receipt phase as a part of office verification.

FIELD VERIFICATION: Verification to be carried out in the field to establish the identity of the applicants and their linkage to the quoted reference in the Legacy Data. All the officials involved would be carrying out their statutory functions of verification in a quasi-judicial manner as per the provisions of The Citizenship Act, 1955, and the Citizenship (Registration of Citizens and Issue of National Identity Cards) Rules, 2003. The verification process would be carried out to identify applicants and authenticate the eligibility claims for inclusion in NRC.

PART PUBLICATION OF DRAFT NRC

The Part Publication of Draft NRC was published at the expiry of midnight of 31st December 2017 by the Government in all the villages/wards where the Application Forms were issued and received. The draft NRC has been made available for public viewing at NSKs as well as on the official NRC website.

COMPLETE PUBLICATION OF DRAFT NRC

The Complete Publication of Draft NRC shall be published by the Government in all the villages/wards where the Application Forms were issued and received. The draft NRC shall be available for public viewing in NSKs as well as on the web on 30th July 2018.

RECEIPT & DISPOSAL OF CLAIMS AND OBJECTIONS

Applicants who do not find their names in the Complete Draft NRC should not be worried or have any apprehensions. THIS IS NOT THE FINAL NRC. Such applicants will get another chance to submit their Claims for inclusion of their names in the Final NRC. There will also be provision to submit Objection against any ineligible entry in Complete Draft NRC. Corrections can also be made in any errors in spellings of names, age, addresses details etc. An application will be required to be submitted to the LRCR at the designated NSK asking for making available the reason of non-inclusion of name(s) in the Complete Draft NRC.

Form for this application is available at the NSK and also available for download online at www.nrcassam.nic.in

Claim and Objections, can be submitted from 30th August 2018 to 31st December 2018. Forms for Claim, Objection or Correction is made available at the NSKs and available for download from www.nrcassam.nic.in from 7th August 2018 onwards.

An application is required to be submitted to the LRCR at the designated NSK asking for non-inclusion of name(s) in the Complete Draft NRC. This process has started from 7th August 2018 to 31st December 2018.

PUBLICATION OF FINAL NRC

After completion of the disposal of claims and the objections final registers at various levels, namely, Local Register of Citizens (LRC), Circle Register of Citizens (CRC), and the District Register of Citizens (DRC) shall then be published as Final Updated SRC (NRC for the state).
