Condition of Jails in 4 NE States not Satisfactory: Gauhati High Court Committee

Guwahati: The committee appointed by the Gauhati High Court to inspect jails in the four states of Assam, Nagaland, Mizoram, and Arunachal Pradesh has submitted its inspection report, which stated that the condition of the jails in all four states is not satisfactory.

The division bench comprising Chief Justice Vijay Bishnoi and Justice Kaushik Goswami, while hearing a Suo Moto case (WP(C)(Suo Moto)/8/2018) on Friday, examined an affidavit filed on behalf of the Registrar General of the Gauhati High Court (HC), which had a report annexed therewith in relation to the inspection carried out by the Committee consisting of the Member Secretary, Assam State Legal Services Authority, DIG, Prison, Guwahati Range, and DIG, Prison, Jorhat Range in respect of different central jails and district jails in the states of Assam, Nagaland, Mizoram, and Arunachal Pradesh.

In the inspection report, the committee highlighted the situation prevailing in the jails of the above-referred four states, and it reported that, by and large, the condition of the jails in all four states is not satisfactory, while making certain recommendations in it.

The bench, however, noted that all four states have not responded to the said affidavit filed on behalf of the Registrar General of the HC and directed the counsel representing the states of Assam, Nagaland, Mizoram, and Arunachal Pradesh to file their respective comprehensive affidavits addressing all the issues highlighted by the Committee in its inspection report.

The bench stated that the affidavits shall contain details as to what measures the four states have taken in respect of the recommendations made by the committee. Also, if those recommendations have not been implemented, then by what time are they going to implement the same?

The bench fixed the date for the next hearing on the matter on January 29, 2025. By that time, the affidavits on behalf of all four states have to be filed positively, the bench stressed.
