‘Are you operating a college in Afghanistan or India?’

GUWAHATI: The Gauhati High Court reprimanded the Principal of the Haji Anfar Ali College in Hojai for rusticating two students for mere dancing in the college. The court also directed the Director of Higher Education, Assam to conduct an inquiry into the incident and to submit the report to the court.
The incident had taken place about one-and-half years back. Two students were rusticated from the college for dancing after a college function was over. A writ petition (WP(C)/7193/2022) had been filed in Gauhati High Court by the two students against the college’s decision. The court, during a hearing in the case, stated, “The college authorities seek to justify their decision on the garb that they are a very disciplined college. If it is so, are we to understand from the Directothe r that rest of the colleges of Assam are indisciplined colleges and there is only one disciplined college namely, Haji Anfar Ali College.”
Justice Achintya Malla Bujor Barua reprimanded the Principal of the college who had been asked to appear before the court. “Is your college in a different classification as far as discipline goes, from any other college under the Government of Assam?” said the court to the college principal. The court further said, “The conduct of your college appears to be more indisciplined than the indiscipline of the students....Are you operating a college in Afghanistan or India?
“Have you not spoiled the future of the students? You are not fit to be a Principal.”
The court then directed the Director of Higher Education, Assam to conduct an enquiry and submit a report before the court on the affairs of the Haji Anfar Ali College on the next date of hearing on October 11, 2023. If any college authorities are found to have exceeded their authority and jurisdiction, the Director has to suggest what appropriate remedial measures are intended to be taken.
