Guwahati: The Assam government has dismissed from service Sharmistha Borah, an ACS officer earlier placed under suspension, for committing irregularities in the implementation of the Members of Parliament Local Area Development (MPLAD) scheme while she was posted as ADC, Kamrup (Metro), with immediate effect.
This was stated in a recent order issued by the Department of Personnel (A), Government of Assam.
The order further said that a disciplinary proceeding was drawn up against Sharmistha Borah, vide a show-cause notice dated August 4, 2023, for committing irregularities in the implementation of the MPLAD scheme while she was posted as ADC, Kamrup (M).
In response to the show-cause notice, Sharmistha Borah submitted her reply in which the officer denied the charges framed against her.
After careful examination of the written statement in defence submitted by Sharmistha Borah and the materials on record, it was decided to hold an inquiry into the charges framed against her, and accordingly, Dr Om Prakash, Commissioner& Secretary to the Government of Assam, was appointed as Inquiring Officer to enquire into the charges framed against Sharmistha Borah through an order issued on October 13, 2023.
Following this, Dr Om Prakash, the inquiry officer of the departmental proceeding, through a letter on October 5, 2024, submitted the inquiry report wherein it was reported that charges no. 1 to 8 of the Show Cause Notice have been proved and sustained against Sharmistha Borah.
Subsequently, the inquiry report was accepted by the disciplinary authority, and Borah was requested, vide letter dated December 6, 2024, to submit her representation against the inquiry report, and she submitted her representation on January 6, 2025.
In turn, the disciplinary authority examined the representation and found that it did not have any new reason for consideration. After considering the magnitude of the offences committed and the charges which were found to be proved, the disciplinary authority decided to impose the penalty of dismissal from service under Rule 7 (vii) of the Assam Services (Discipline & Appeal) Rules, 1964.
The Assam Public Service Commission, on being consulted in the matter, agreed to the proposed penalty of ‘dismissal from Service’ upon Sharmistha Borah.
Finally, the Assam government imposed the penalty of dismissal from service, which shall ordinarily be a disqualification for future employment upon Sharmistha Borah, with immediate effect, the order stated.
It should be mentioned here that the irregularities committed by Sharmistha Borah related to the implementation of MPLAD funds of a Rajya Sabha member of Assam.
